Rafal Car - General Terms and Conditions

ARTICLE 1: Object of the Contract

The purpose of this contract is the rental to the lessee of a production vehicle in good condition, well-equipped, and insured.

ARTICLE 2: Condition of the Vehicle

• The Client declares having verified that the rented vehicle is in good condition and well-equipped. In case of deterioration, the Client is responsible for compensation at the price of the repair.
• Normal mechanical wear and tear is the responsibility of Rafal Car. Abnormal wear, negligence, or accidental damage is the Client's responsibility.
• Worn or damaged mechanical parts (oil pan, crossmember, steering arms, etc.) are the Client's responsibility.
• The Client agrees to circulate the vehicle only on proper roads and avoid tampering with the odometer.
• The Client is formally prohibited from leaving Moroccan territory without written authorization from Rafal Car.
• The rented vehicle may NOT be used for: Racing, competitions, commercial transport, towing, or illegal activities.

ARTICLE 3: Insurance & Vehicle Use

• The vehicle is insured against theft, fire, and third-party liability.
• The Client is informed of insurance policy conditions and deductibles.
• The Client may waive participation in costs through insurance supplements (Maximum 45 days).
• The Client must declare any accident within 24 hours and provide police/gendarmerie reports.

ARTICLE 4: Rental Period

• The rental is agreed upon for a specific duration stated in the contract.
• It ends at the time and date of return stipulated in the contract.
• If the Client wishes to extend, they must inform Rafal Car 48 hours before expiration.
• The Client must NOT dispute liability or compromise with third parties in case of accidents.

ARTICLE 5: Payment

• A rental day is counted from pickup time. Any started day is due.
• Late returns will incur additional rental fees and penalties.
• Failure to return may result in criminal prosecution per Moroccan Penal Code Articles 505 and 516.
• Late payment interest: 6% from formal notice date.
• Penal clause: 20% of amount due (minimum 250 MAD).
• Compensation: 250 MAD per day beyond 72 hours delay.

ARTICLE 6: Vehicle Documents

The Client must return to Rafal Car the vehicle with gray card (carte grise), insurance certificate, and technical inspection documents. Failure results in recovery costs or duplicate establishment fees.

ARTICLE 7: Responsibility

• The Client agrees not to let anyone drive except authorized persons (in writing from Rafal Car).
• The Client must immediately notify Rafal Car of all contraventions and fines.
• The Client must provide a valid driving license for the rental period.

ARTICLE 8: Obligations

• Legal costs, taxes, appraisals, and formalities are borne by the Client.
• The Client is fully responsible for third-party damages.
• The Client agrees to rental prices as per rates in force.
• The Client must not make changes to the vehicle.
• The Client must sign the vehicle return note with observations.

ARTICLE 9: Termination of Contract

• Non-compliance with any condition authorizes Rafal Car to take back the vehicle without notice.
• False declarations, misuse, or non-payment are grounds for immediate termination.
• Rafal Car reserves the right to withdraw the vehicle and pursue legal action.
